Overview

These Terms of Service govern use of FoundryNorthGolf.com and purchases from Foundry North Golf. By using the website or placing an order, you agree to these Terms and to the policies linked from the website, including the Privacy, Shipping, and Refund and Return Policies.

Eligibility and lawful use

You may use the website only for lawful purposes. You may not misuse the website, interfere with its operation, introduce malicious code, attempt unauthorized access, scrape or reproduce content unlawfully, commit fraud, or violate another person’s rights.

Product information

We try to describe products, specifications, compatibility, colors, pricing, and availability accurately. Displayed colors may vary by device, screen, lighting, and photography. Product photographs and descriptions do not authorize alteration or copying of Foundry North Golf intellectual property.

Golf grips and ferrules should be installed using appropriate tools, materials, and techniques. Customers are responsible for determining whether a product is appropriate for their equipment and installation method. When uncertain, use a qualified club builder.

Orders and acceptance

An order confirmation acknowledges that we received an order; it does not require us to accept or fulfill an order that contains an obvious pricing error, suspected fraud, unavailable inventory, unsupported shipping destination, or other material problem. If we cancel an order after payment, we will refund the canceled amount.

We may reasonably limit quantities or decline orders intended for unauthorized resale. Wholesale inquiries should be directed to hello@foundrynorthgolf.com.

Prices, payment, and promotions

Prices are shown in the currency displayed at checkout. Applicable taxes, shipping charges, discounts, and the final order total are shown before purchase. Payment is processed through Shopify and its supported payment providers.

Promotions are subject to their stated eligibility, timing, product, quantity, and combination rules. The launch quantity offer provides 10% off an eligible cart containing 10 or more Foundry North grips. Eligible grip colors may be combined to reach the quantity threshold. Unless expressly allowed, promotions cannot be combined or applied retroactively.

Preorders

Preorder payment is collected at checkout. The estimated shipping timing and treatment of orders containing both preorder and in-stock products are stated in the Shipping Policy and on applicable product pages. Unshipped preorders may be canceled for a full refund. If expected timing changes, we will provide the notice and options described in the Shipping Policy.

Shipping, returns, and refunds

Shipping, returns, exchanges, cancellations, and refunds are governed by the Shipping Policy and Refund and Return Policy. Those policies form part of these Terms.

Intellectual property

The website and its content—including the Foundry North Golf name, loon mark, product designs, photographs, graphics, text, and layout—are owned by or licensed to Foundry North Golf and are protected by applicable intellectual-property laws. No license is granted except the limited right to use the website for personal shopping and information.

Third-party services and links

The store is hosted by Shopify and may use third-party payment, shipping, analytics, advertising, and other services. Third-party services and websites may be governed by their own terms and privacy policies. Foundry North Golf is not responsible for third-party websites that it does not control.

Reviews and submitted content

If you submit a review, photograph, message, or other content for publication, you represent that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights. We may decline or remove unlawful, fraudulent, abusive, or irrelevant content. We will not condition a reward on a positive review.

Disclaimer

Except as expressly stated in these Terms or required by law, the website and products are provided without additional warranties. We do not guarantee that the website will always be uninterrupted or error-free. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, Foundry North Golf will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or products. Any direct liability will be limited to the amount paid for the product or order giving rise to the claim, except where applicable law prohibits that limitation.

Indemnification

To the extent permitted by law, you agree to indemnify Foundry North Golf against third-party claims arising from your unlawful misuse of the website, violation of these Terms, or infringement of another person’s rights.

 Severability, waiver, and entire agreement

If a provision of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. These Terms and the incorporated policies constitute the agreement concerning use of the website and purchases from Foundry North Golf, except for any additional terms expressly accepted for a specific transaction.

Changes

We may update these Terms from time to time by posting a revised version and updating the last-revised date. Changes apply prospectively unless applicable law requires otherwise.
